Call Recording: Legal Requirements and Best Practices

Call recording is one of the most valuable tools a business can have. It's also one of the most misunderstood from a legal perspective. Here's what you actually need to know.

The basic legal split:

One-party consent countries (including the US in most states, Russia, Kazakhstan, Uzbekistan): only one person in the call needs to know it's being recorded. If you're the business, you consent — recording is generally permitted.

Two-party consent countries (including most of the EU, UK in some contexts): all parties must be notified and consent. A disclosure message at the start of the call satisfies this in most cases.

What satisfies the requirement in practice:

An automated message before the call connects: "This call may be recorded for quality and training purposes." In two-party consent jurisdictions, a caller who stays on the line after this message has implicitly consented in most legal frameworks.

Best practices beyond legal compliance:

Store recordings securely with access controls. Only supervisors and compliance teams should have unrestricted access.

Set a retention policy. 90 days is standard for quality assurance. Legal and compliance cases may require longer retention.

Use recordings actively. Listening to 5–10 calls per agent per week reveals more about your team's performance than any metric dashboard.

Tell your team recordings exist. This alone improves call quality — not through surveillance, but through accountability.
